Kai has a civil suit that could cost the state of New Jersey, Union County and some of the individuals involved in the alleged cover-up millions of dollars. It’s not surprising that a federal judge faced with the same evidence wouldn’t be as reticent to note the glaring inconsistencies and 1983 civil rights and due process violations. Unfortunately, due to the Heck v. Humphrey ruling, even if you can prove that evidence was tampered with or destroyed and had it not been a different disposition would have resulted, nothing can be done until the state case is vacated. Essentially a Catch-22 situation.
